American Gutter Filter, Inc. . hereby extends a *5-Year Limited Warranty. If *GutterFill® PRO , *GutterFill® Extreme or *Safe-T-Flow® (which may be hereinafter referred to as "product or products") fails to keep the gutters flowing due to interior debris that clogs the gutter or downspouts. American Gutter Filter, Inc., will, at its sole option, replace (as hereinafter defined) the product under the terms of this warranty.
*GutterFill® rain gutter debris filter inserts come with a *5-Year Limited Warranty. If *GutterFill® (which may be hereinafter referred to as "product or products") if fails to keep the gutters flowing due to interior debris that clogs the gutter or downspouts. American Gutter Filter, Inc., will, at its sole option, replace (as hereinafter defined) the product under the terms of this warranty.
Repairs:
Upon receipt of your warranty claim, which must be submitted via email to service@americangutterfilter.com, and provided the product is covered by this warranty at the time such claim is made, we will replace the item at no charge to you, within thirty (30) days. The thirty (30) day time period shall be extended for any delays outside of the control of American Gutter Filter, Inc, including but not limited to weather conditions, acts of God, labor problems, or material shortages which cause delays. The replacement obligation shall be satisfied by shipping a new product, of the same or similar class and with the same or similar attributes as the product being replaced directly to you, whereupon you will be responsible for installation and any cost incidental thereto. Furthermore, the replacement obligation hereunder shall be limited to a one time only shipment of replacement product and this warranty shall not be extended to the replacement product. Under no circumstances shall American Gutter Filter, Inc. be obligated to make any in-home service calls. We reserve the right to discontinue or change any design or any product without notice or liability. If for any reason products of any particular type or design are no longer available, American Gutter Filter, Inc. at its sole discretion will replace the product under this warranty with a product American Gutter Filter, Inc. determines to be of comparable quality and price. It is your obligation is to provide American Gutter Filter when asked for it any information helpful to expedite your claim.
Installation:
Products must be installed in thoroughly cleaned gutters with all downspouts and under ground downspouts clear of debris and or obstructions. Gutters must be pitched equal to or greater than 1 inch for every 10 linear feet of gutter pitched towards the closest downspout. Because various factors will affect the product’s performance including, but not limited to, roof pitch, roof, downspout size, topical debris, roof corners, gutter turns, aged gutters and weather conditions the occasional inspection and maintenance may be required by homeowner to ensure free flowing gutters. Maintenance is defined as, but not limited to, the removal of accumulated debris on top of the products. If the product is claimed by the homeowner to be defective in any way, American Gutter Filter, Inc. may, at its sole discretion, require the homeowner to remove and return the installed product, or a portion thereof, at its own expense, complete with photographs of the product as installed and a email and or letter describing the manner in which the product is claimed to have failed. Costs of removal, shipping, re-installation and labor incident thereto are not covered by this warranty. Labor fees incurred from any install or installation are not covered under this warranty.
Exclusion from Coverage:
Homeowner and its insurer agree that this warranty shall not extend to damage suffered for which the homeowner seeks payment pursuant to an insurance claim, including, but not limited to, any homeowner’s / hazard insurance or workman’s compensation insurance claims, or any claims of product defect or destruction based on fire, flood, tornado, environmental elements, or other Act of God or occurrences beyond the control of AGF, Inc.. Any installed product that is molested and/or removed prior to filing a claim pursuant hereto voids this warranty, unless such removal is done at our direction. Surface debris on the system is a natural occurrence and neither seeds that may or may not root or sprout or damage from animals is not covered.
We do not assume responsibility for any of the following, all of which are excluded from coverage of the Warranty:
- Damage to the product due to abusive use or lack of proper maintenance of your home or if the product is to be used to filter water for rain barrels or for any secondary needs, subject to but not limited to human, plant, or animal consumption.
- Defects, or alterations caused by workmanship done by you or anyone else that installs and otherwise handles product, or replacement product.
- Consequential or incidental damages (sometimes called secondary damages).
- Damage to product that occurs from but not limited to, pesticides, bleach, oils, paints, stains, chemical strippers, ultraviolet rays, installation or acid rain are not covered by this warranty.
- Discoloration, changes in surface color, crusting, staining, soiling, fading or shrinkage is not covered. Exposure to elements may cause these changes over time. The degree to which weathering takes place will vary due to the location geographically, local conditions, building location, air quality, and toxic conditions which we have no control.
- Slow drainage caused by, but not limited to, the following conditions: pitched gutters, roof pitch, rain, limited downspouts or under size (2x3) downspouts.
- Not to be used with any potable water collection systems.
Additional Terms and Conditions:
- Multiple dwellings such as but not limited to, condos, apartments, townhouses and duplexes are required that each tenant to register warranty separately within 30 days of purchase regardless of whom purchased or installed product.
- Product will burn under certain conditions. Ember / Fire resistance may or may not be affected by the elements over time.
- *Fully coated is defined as top side, underneath side, back side of product. The ends of the product may or may not be coated. Coating application amounts may or may not vary on each individual product or piece.
- Retail, Internet manufacture direct purchases, Internet transactions, Invoiced, or Invoiced Internet transactions paid by check through the mail have a valid warranty for ninety days from date of purchase. After ninety days warranty of product is void.
- American Gutter Filter, Inc. reserves the right to update advertisements and warranty at anytime without notification.
- This warranty is only valid in the United States and Canada.
- This limited warranty given is in lieu of any other warranties, express or implied and all such warranties including but not limited to warranties of merchantability and fitness for a particular purpose are hereby excluded.
- Products that are not registered or registered in time are not covered by this warranty and American Gutter Filter, Inc. and its affiliates hold no responsibility to inform or insure product or products are registered under the warranty agreement. Warranty registration must be done within 30 days of purchase or the warranty is void. Registration may done only via the world wide web at http://www.americangutterfilter.com/Warranty-Registration.aspx.
- If you purchase American Gutter Filter Inc. products GutterFill® or GutterFill®Pro at a retailer or a online retailer. You will need to download your warranty at: www.gutterdebrisfilter.com. American Gutter Filter, Inc. reserves the right to have different warranty programs depending on how and were items are purchased at any time. Retail warranty is different, and only applicable to retail purchases.
- This product has not been registered by the United States Environmental Protection Agency. American Gutter Filter Inc. represents that this product qualifies for exemption from registration under the Federal Insecticide, Fungicide and Rodenticide Act. Active Ingredients: Citronella: .005%, Lemongrass Seed Oil: .001%
- Venue and Governing Law. This warranty will be governed by the laws of the State of Illinois, without regard to conflicts of law principles. Any claim, cause of action or law suit relating to any claim arising hereunder shall be filed exclusively in the Kane County Circuit Court of the Sixteenth Judicial Circuit for the State of Illinois.
